Defending the Clean Power Plan

In response to legal challenges against the EPA’s Clean Power Plan, ASBC and the South Carolina Small Business Chamber of Commerce will file an amicus brief (also known as a “friend of the court” brief) on behalf of the plan. The plan was recently stayed by the Supreme Court, preventing it from going into effect until legal challenges have been exhausted. The DC Circuit Court of Appeals will take up the case soon.
Our amicus brief will emphasize the economic costs of inaction on climate change, and the economic benefits of addressing climate change using a flexible approach that encourages innovation and market solutions.
